THE MISCELLANEOUS RESOLUTIONS ARE APPROVED AS AMENDED. WE NOW HAVE ONE PRESENTATION HONORING TOTES FOR BUFFALO FOUNDER AND THE CITIZEN OF THE MONTH AND LEGISLATOR GREENE WILL CONDUCT THAT PRESENTATION. COME ON UP. [INAUDIBLE] THANK YOU, MADAM CHAIR, FOR PROVIDING THE DAIS AND THE OPPORTUNITY. FOR THOSE WHO PAID ATTENTION IN THE LAST FEW YEARS WHENEVER I HAVE AN OPPORTUNITY TO DO A CITIZEN OF THE MONTH, THERE'S LOTS OF DIFFERENT ACHIEVEMENTS, WHETHER IT'S IN THE ATHLETIC FIELD BUSINESS WORLD. I ALWAYS LOOK FOR PEOPLE WHO GO OUT OF THEIR WAY TO MAKE OTHER PEOPLE'S LIVES BETTER. I'VE ALWAYS BEEN INVOLVED WITH VARIOUS ORGANIZATIONS AND VOLUNTEERED MY TIME. OVER THE LAST 20 YEARS, I'VE WATCHED VOLUNTEERISM GO DOWN, NOT JUST IN ERIE COUNTY, BUT ACROSS THE UNITED STATES. PEOPLE ARE BUSY. THEY HAVE THEIR OWN FAMILIES, TYPICALLY TWO INCOME HOUSEHOLDS, AND THEY DON'T HAVE NECESSARILY THE TIME TO TAKE CARE OF THEIR FELLOW HUMANS AND THEIR FELLOW CITIZENS, WHICH IS WHY IT'S IMPORTANT THAT WE CONTINUE TO ENCOURAGE THIS TYPE OF ACTIONS, AND HERE ARE A COUPLE OF WOMEN WHO TOOK CIRCUMSTANCES IN THEIR OWN LIVES AND WERE ABLE TO START A NONPROFIT ORGANIZATION TO HELP INDIVIDUALS WHO ARE GOING THROUGH LONG TERM ILLNESSES AND HOW TO COPE WITH THAT, AND THEY CAN APPLY WHAT THEY LEARN TO HELP OTHERS. SO THEY'LL PLAY A VIDEO HERE IN A SECOND THAT KIND OF DOES A BETTER JOB EXPLAINING IT, AND THEN I'LL READ THE PROCLAMATION IF YOU COULD. THANK YOU SO MUCH. THE MISSION OF HOPE IS TO OFFER COMFORT, LOVE AND SUPPORT TO BOTH CAREGIVERS AND PATIENTS WHEN THEY'RE DIAGNOSED WITH [00:05:08] A SERIOUS MEDICAL ILLNESS. BACK IN 2018, MY SON WAS DIAGNOSED WITH A BRAIN TUMOR, AND I CALLED COLLEEN BECAUSE I KNEW THAT SHE HAD INTIMATE AWARENESS OF HOW TO CARE FOR A CHILD WITH A CHRONIC ILLNESS. SHE SHOWED UP AT THE HOSPITAL WITH A TOTE, AND INSIDE THE TOTE WAS A MEDICAL BINDER TO ORGANIZE THOMAS'S CARE PLAN, AND IT HAD A BLANKET FOR ME AND SLIPPERS FOR ME, KNOWING THAT I WAS GOING TO BE IN THOSE COLD WAITING ROOMS ALONG WITH THOMAS. FAST FORWARD A COUPLE OF YEARS LATER. MY FRIEND, HER DAUGHTER, WAS DIAGNOSED WITH CANCER. I KNEW EXACTLY WHAT SHE NEEDED. I COMPILED A HOPE TOTE MEDICAL BINDER, ALL OF THAT, AND SHIPPED IT OFF, AND I CALLED COLLEEN AND SHE HAD BEEN MAKING TOTES FOR A BUNCH OF HER. YOU'RE KIDDING ME. I'M MAKING ONE RIGHT NOW, AND I SAID, THIS SETS MY HEART ON FIRE. I SAID, WE HAVE GOT TO DO THIS. THERE'S A NEED HERE. OFF IT WENT TO CREATE THE [INAUDIBLE] THINK CAREGIVERS IN GENERAL NEED MORE SUPPORT BECAUSE WHEN YOUR LOVED ONE IS DIAGNOSED WITH SOMETHING, YOUR ONLY FOCUS IS TO CARE FOR THEM AND HEAL THEM AND MAKE THEM FEEL BETTER. SO THAT'S WHAT WE FEEL LIKE. WE CAN STEP IN AND WE'RE HOLDING UP THOSE CAREGIVERS. WE'RE SAYING, HERE, TAKE THIS TAKE. IT'S JUST GOING TO MAKE EVERYTHING ELSE GIVES YOU A LITTLE STRENGTH TO GO ON THE NEXT DAY AND GIVE YOUR ENERGY TO THE PERSON YOU LOVE. IT WAS JUST A BLESSING TO GIVE BACK AND USE THIS VEHICLE TO HEAL OUR OWN HEARTS AND ALSO GIVE BACK TO A COMMUNITY THAT WRAPPED US UP WHEN WE WERE GOING THROUGH THE SAME THINGS. SO WHAT STARTED OUT AS JUST ONE FRIEND HELPING ANOTHER HAS TURNED IN TO AN OUTSTANDING ORGANIZATION OF HELPING PEOPLE THAT THEY DON'T KNOW GET THROUGH WHAT INEVITABLY WILL BE THE MOST DIFFICULT TIMES OF THEIR LIFE. PARTICULARLY, THEY GO BEYOND JUST CHILDREN WITH AN ILLNESS ANYBODY WITH A LONG TERM ILLNESS, BUT PARTICULARLY ALL OF US OUR PARENTS, WE CAN IMAGINE AND SYMPATHIZE WHAT ANYBODY GOES THROUGH WITH A SICK CHILD. SO IF YOU DON'T MIND REAL QUICK, I'D LIKE TO JUST READ THE PROCLAMATION. WHEREAS THERE CAN BE NO GREATER VIRTUE IN SOCIETY TODAY THAN THE ABILITY TO CARE FOR OTHERS AND PROVIDE RELIEF AND COMFORT TO THOSE WHO FIND THEMSELVES IN GREAT IN TIMES OF GREAT NEED, AND WHEREAS, AS THE FOUNDERS OF HOPE TOTES, CLARENCE RESIDENT COLLEEN MARCHETTA AND AMHERST RESIDENT AMY VELEZ ARE EXEMPLARS OF WHAT IT MEANS TO SHOW COMPASSION TO THEIR FELLOW MAN, AND WHEREAS, LIKE MANY WONDERFUL CAUSES AND IDEAS THAT ARE BORN OUT OF TRAGIC CIRCUMSTANCES AND SIGNIFICANT CHALLENGES, THE CONCEPT OF HOPE, TOTES AND ITS GROWTH OVER THE YEARS CAME AS A RESPONSE TO SERIOUS MEDICAL CONDITIONS FACED BY COLLEEN'S SON JACKSON AND AMY'S SON THOMAS, AND WHEREAS, TO PREPARE FOR THE DIFFICULT TASK OF ORGANIZING MEDICAL RECORDS, TREATMENT REGIMENS AND OTHER OUTCOMES AND SIDE EFFECTS, AS WELL AS TRAVEL AND LODGING TO VARIOUS HOSPITALS AND TREATMENT FACILITIES, COLLEEN AND AMY, THROUGH HOPE TOTES DEVELOPED AN EASY TO USE TOTE SYSTEM FOR ORGANIZING ALL OF THESE FUNCTIONS AND WHEREAS, RECOGNIZING THAT THERE IS A GREAT NEED TO PROVIDE PERSONAL COMFORT, A HOPE TOTE ALSO INCLUDES A BLANKET SLIPPERS ITEMS SPECIFIC TO THE PATIENT OR CAREGIVER'S NEEDS. A HOPE JOURNAL AND A PERSONALIZED LETTER FROM COLLEEN AND AMY TO COMFORT AND ENCOURAGE THE RECIPIENT OF THEIR TOTE, AND WHEREAS, THE SIXTH LEGISLATIVE SIXTH DISTRICT, ERIE COUNTY AS A WHOLE AND THE GREATER WESTERN NEW YORK COMMUNITY ARE A BETTER, KINDER AND MORE LOVING PLACE TO LIVE BECAUSE OF COLLEEN AND AMY, COMMITMENT TO HOPE, TOTES AND ITS MISSION TO PROVIDE COMFORT AND LOVE FILLED WITH SUPPORT TO PATIENTS AND CAREGIVERS IN TIMES OF MEDICAL NEED. NOW, THEREFORE, BE IT RESOLVED THAT THE ERIE COUNTY LEGISLATURE PAUSES IN ITS DELIBERATIONS TO RECOGNIZE COLLEEN MARCHETTA AND AMY VELEZ, FOUNDERS OF HOPE TOTES, AS THE ERIE COUNTY LEGISLATURE'S SIXTH DISTRICT CITIZEN OF THE MONTH FOR JUNE 2023, AND TO THANK THESE OUTSTANDING WOMEN FOR THEIR EXCEPTIONAL CONTRIBUTIONS TO OUR COMMUNITY. COLLEEN, THANK YOU VERY MUCH. [INAUDIBLE] WANT TO SAY REAL QUICK, [00:10:02] THANK YOU EVERYONE, SO MUCH. WE'RE SMILING A LOT BECAUSE WE'RE SO EXCITED TO BE HERE TODAY. SO WE REALLY JUST APPRECIATE LEGISLATOR GREENE TAKING THE TIME TO HONOR US IN SUCH A NICE SURPRISE, AND THAT WAS THE SWEETEST THINGS THAT WERE WRITTEN IN THERE. SO THANK YOU. IT'S STUFF LIKE THIS THAT ENCOURAGES US TO KEEP GOING, AND THANK YOU EVERYONE, JUST FOR LISTENING TO THIS AND LETTING US SHARE ABOUT SOMETHING THAT WE REALLY FEEL IS SOMETHING VERY IMPORTANT THAT WE CAN DO TO HELP OTHERS GOING THROUGH ANY SORT OF SERIOUS MEDICAL DIAGNOSIS, BECAUSE WE'VE NOTICED THAT WAS AN AREA THAT THERE WAS A NEED FOR AND THAT NO ONE WAS STEPPING IN TO DO , AND IF YOU KNOW OF ANYONE, AND I'M SURE EVERYONE HERE DOES WHO HAS BEEN DIAGNOSED WITH SOMETHING SERIOUS, YOU'RE NOT GOING TO AN OFFICE SUPPLY STORE AND SAYING, I'M GOING TO GET ORGANIZED AND LEARN EVERYTHING ABOUT THIS. OFTENTIMES YOU'RE JUST TAKING EVERYTHING YOU GET AND YOU'RE OVERWHELMED. WHEN MY SON WAS DIAGNOSED WITH A RARE DISEASE, I HAD A BACKPACK FOR THREE YEARS THAT I JUST THREW PAPERS OUT OF BUSINESS CARDS FROM DOCTORS. HE HAD SO MANY SPECIALISTS I HAD TO LEARN HOW TO GIVE HIM A CHEMOTHERAPY SHOT ON DAY ONE. I REMEMBER RUNNING ALL OVER THE HOUSE LOOKING FOR THE PAPERS THAT GAVE THE DIRECTIONS BECAUSE I HAD TO HOLD MY TWO YEAR OLD DOWN AND GIVE HIM A SHOT AND THEN GET READY FOR THE AFTERMATH OF THOSE MEDICINES, AND THE LAST THING I'M THINKING ABOUT IS HOW I'M GOING TO STAY ORGANIZED OR THINK ABOUT MYSELF WHEN WE ARE RUSHING LAST MINUTE TO GO TO THE HOSPITAL AND IT'S UNEXPECTED AND THEN WE'RE THERE FOR A WEEK. SO THAT'S SOME OF THE OTHER THINGS THAT WE KEEP IN THE TOTE, AND I'D LIKE TO JUST SHOW YOU , I HOPE THAT'S OKAY. SO YOU CAN KIND OF SEE WHAT IT'S ABOUT. SO THE WHOLE CONCEPT IS THAT A PATIENT OR A CAREGIVER WILL JUST ALWAYS HAVE THIS READY. THEY'RE GOING TO A DOCTOR'S APPOINTMENT. THEY'RE GIVEN INFORMATION. THEY HAVE A MEDICAL BINDER WITH A THREE HOLE PUNCH IN THERE. I DON'T KNOW IF YOU'VE EVER BEEN TO THE HOSPITAL, THE PAPERS, YOU GET A LOT OF PAPERS, BUT YOU HAVE TO FIND A HOLE PUNCH JUST TO PUT IT AWAY. SO THIS JUST MAKES IT EASY TO PUT IT IN. HIGHLIGHTERS, PENCILS, PENS WITH ERASERS, BINDERS TO KIND OF ORGANIZE THINGS, THINGS LIKE SIDE EFFECTS FROM MEDICATIONS, INSTRUCTIONS ON HOW TO USE THINGS. OFTENTIMES WHEN YOU'RE DIAGNOSED WITH SOMETHING NEW, A LOT OF QUESTIONS COME UP AND YOU HAVE TO MAKE LISTS. SO WHEN YOU GO TO YOUR DOCTOR'S APPOINTMENT, YOU CAN TALK TO THEM ABOUT THOSE THINGS. THAT'S WHAT THE HOPE JOURNAL'S FOR; IT'S A PLACE TO KEEP ALL THAT. WHEN YOU ARE IN THE HOSPITAL, WHETHER YOU ARE THE PATIENT OR CAREGIVER, YOU NEED YOU NEED TO BE COMFORTED. SO THIS IS JUST A VERY COMFORTABLE BLANKET AND A PILLOW, JUST KIND OF A REMINDER TO LET THE PERSON KNOW THAT THEY'RE LOVED AND THOUGHT OF. WE HAVE COLORING BOOKS IN HERE TO KIND OF JUST CALM YOU, WHETHER YOU'RE GETTING A CHEMOTHERAPY TREATMENT OR ANYTHING, JUST TO KIND OF BRING YOU PEACE DURING THAT TREATMENT AND WE HAVE THINGS LIKE HATS, SLIPPERS, SLIPPERS ARE A FUNNY THING BECAUSE I REMEMBER BEING IN THE HOSPITAL WITH MY SON AND I HOP IN AND OUT OF THE BED TO GET HIM THINGS HAPPENING OUT OF THE BED. HIS SNEAKERS HAD TO GO SOMEWHERE JUST TO HAVE SLIPPERS TO SCOOT AROUND THE HOSPITAL, ESPECIALLY WHEN YOU'RE THERE FOR AN ENTIRE WEEK. VERY HELPFUL. SO JUST I THINK PEOPLE BEING GIVEN THIS GIFT. WE'VE GOTTEN A LOT OF FEEDBACK, TOO, ABOUT IT, THAT IT'S SO EASY FOR THEM TO TAKE THIS TO THEIR CHEMOTHERAPY APPOINTMENTS, TO TAKE THIS TO THEIR CHILDREN'S MEDICAL APPOINTMENTS. WE'VE HAD IVF PATIENTS, WE'VE HAD DEMENTIA PATIENTS, AND THE CAREGIVER USES THIS WHEN CARING FOR THEM. SO WE GET LOTS OF WONDERFUL NOTES AND WE KNOW THAT WE NEED TO KEEP DOING THIS. SO WE'VE DONE 800 TOTES SO FAR. WE'RE IN THE WORKS TO HAVE ANOTHER PACKING PARTY FOR ANOTHER COUPLE HUNDRED TOTES, SO WE'LL BE OVER A THOUSAND SOON, AND WE'RE JUST WE'RE JUST EXCITED. IT FEELS IT FEELS GOOD TO GIVE BACK, AND I DON'T KNOW IF YOU WANT TO THROW ANYTHING ELSE IN THERE. [INAUDIBLE] YOU DID GREAT. YOU DID GREAT. THANK YOU SO MUCH FOR YOUR TIME TODAY. WE APPRECIATE THE HONOR. ABSOLUTELY. THANK YOU, AND THE LAST THING I WANT TO MENTION IS A YEAR AGO, I HAD ONE OF THE ORGANIZATIONS UP HERE WITH VICTORY SPORTS, AND ONE OF THE LEGISLATURES ACTUALLY REACHED OUT FOR SOME ASSISTANCE WITH THE SPORTS ORGANIZATION IN THEIR IN THEIR IN THEIR DISTRICT. AS FAR AS GETTING EQUIPMENT, I WOULD ENCOURAGE EVERYBODY THESE THESE LADIES DO NOT JUST SIT IN LEGISLATIVE DISTRICT SIX. WHEREVER THERE'S A NEED THEY WILL GO, THEY WILL ASSIST, AND IN THE HIGHEST TIMES OF STRESS, THEY'LL HELP ALLEVIATE THAT AND HELP YOU TO FOCUS ON YOUR LOVED ONE WHEN NOBODY'S FOCUSING ON YOU. SO LASTLY, THANK YOU FOR BOTH OF YOU FOR DOING WHAT YOU DO. WE REALLY APPRECIATE IT. THANK YOU. THANK YOU. IF YOU DO WANT TO REACH OUT AND REQUEST A TOTE, WE ARE ON THE WEB. YOU CAN GO TO HOPETOTESBUFFALO.ORG AND YOU CAN REQUEST A TOTE, AND IF YOU'RE EVER DOING ANYTHING WE DO A LOT OF DROP OFFS TOO OF SHY ROSWELL, A LOT OF LOCAL ORGANIZATIONS HERE. IF THERE'S SOMETHING YOU EVER WANT TO GET INVOLVED IN, WE WOULD LOVE TO HAVE YOUR SUPPORT AND YOUR HELP WITH ANYTHING, WHETHER IT'S A SLIPPER DRIVE BINDER DRIVE, WHETHER YOU WANT [00:15:03] TO HELP PACK TOTES OR DELIVER THEM ANYTHING. WE WOULD MORE THAN WELCOME. WE ARE 100% VOLUNTEER, SO THAT WOULD BE WONDERFUL. THANK YOU AGAIN. THANK YOU. ONE FOR YOU. THANK YOU. THANK YOU. OKAY. BEAUTIFUL PRESENTATION. THANK YOU TO HOPE TOTES FOR THEIR DEDICATION TO COME. [ LOCAL LAWS:] CONTINUING ON WITH OUR AGENDA. ON YOUR TABLET WE'RE HEADING TO LOCAL LAWS. IF ARE IN THE PAPER COPY, WE ARE ON PAGE THREE. REPORT NUMBER SEVEN FROM THE FINANCE AND MANAGEMENT COMMITTEE. COMMITTEE CHAIR MEYERS. THANK YOU, MADAM CHAIR. I MOVE FOR IMMEDIATE CONSIDERATION. REPORT NUMBER EIGHT FROM THE HEALTH AND HUMAN SERVICES COMMITTEE COMMITTEE CHAIR GILMORE FOR IMMEDIATE CONSIDERATION AND APPROVAL. THERE'S BEEN A PROPER MOTION MADE BY THE COMMITTEE CHAIR. IT'S BEEN SECONDED BY LEGISLATOR JOHNSON ON THE QUESTION. ALL IN FAVOR? ANY OPPOSED? OKAY. THE REPORT IS APPROVED. [ LEGISLATOR RESOLUTIONS:] LEGISLATOR RESOLUTIONS INTRO 15-1. THIS IS FROM LEGISLATOR BASKIN REGARDING THE NEW BILLS LEASE STADIUM PROJECT MWBE OUTREACH AND RECRUITMENT ANALYSIS. THERE HAS BEEN AN AMENDMENT THAT HAS BEEN PRESENTED SO ON THE MOTION TO AMEND. MAJORITY LEADER MOVE TO CONSIDER. OH, SORRY, THERE'S BEEN A MOTION TO CONSIDER THE ITEM MADE BY THE MAJORITY LEADER. IT'S BEEN SECONDED BY LEGISLATOR JOHNSON ON THE QUESTION. ALL IN FAVOR? AYE. ANY OPPOSED? OKAY. THE ITEM IS NOW BEFORE THE BODY. MAJORITY LEADER. THANK YOU, MADAM CHAIR. MOVE TO AMEND WITH WHAT'S BEEN PASSED OUT. THERE'S BEEN A PROPER MOTION TO AMEND THE ITEM WITH WHAT'S BEEN PASSED OUT MADE BY THE MAJORITY LEADER. IT HAS BEEN SECONDED BY LEGISLATOR JOHNSON ON THE QUESTION. ALL IN FAVOR? AYE. ANY OPPOSED? OKAY. THE ITEM IS AMENDED. MAJORITY LEADER. THANK YOU, MADAM CHAIR. MOVE TO APPROVE AS AMENDED. THERE'S BEEN A PROPER MOTION TO APPROVE AS AMENDED MADE BY THE MAJORITY LEADER. DO WE HAVE A SECOND? SECOND. SECOND BY LEGISLATOR JOHNSON ON THE QUESTION. I'LL SPEAK ON THE QUESTION. MR. CLERK. I JUST WANT TO THANK MY COLLEAGUES FOR CONSIDERING THIS ITEM AND UNDERSTANDING THAT WE DO NEED TO PRIORITIZE WOMEN, MINORITY AND DISABLED VETERANS AND THEIR INCLUSION AS IT RELATES TO STATE LOCAL LAWS THAT SAY THAT WE HAVE TO HAVE GOALS TO INCLUDE THEM ON CONSTRUCTION PROJECTS THAT USE PUBLIC DOLLARS BUT MOST IMPORTANTLY, BECAUSE THIS HONORABLE BODY HAS DONE SUCH A BEAUTIFUL JOB SINCE COVID-19 OF PRIORITIZING OUR CARE AND OUR INTERESTS FOR SMALL BUSINESSES FROM THE BACK TO BIZ PROGRAM TO THE STOREFRONT REVITALIZATION PROGRAM TO WHAT WE'RE WORKING ON RIGHT NOW WITH THE OFFICE OF THE SHERIFF, WITH THE FORMER DETAINEE TO EMPLOYEE PROGRAM. I KNOW THAT IT IS IN THE WORK THAT WE'VE DONE WITH LOCAL ARTS AND PRIORITIZING ARTISTS. WE ARE REALLY, REALLY PASSIONATE AND I'M PROUD TO BE OF THIS CLASS OF LEGISLATORS TO MAKE SURE THAT SMALL BUSINESS OWNERS GET ACCESS TO OPPORTUNITIES TO [00:20:09] STABILIZE THEM ECONOMICALLY, AS THAT'S WHAT KEEPS OUR COMMUNITY THRIVING. SO THIS ANALYSIS IS GOING TO BE THE BEGINNING OF THIS BODY, AS THE MINORITY LEADER SAID, MAKING SURE THAT WE DO OUR DUE DILIGENCE TO MAKE SURE THAT THOSE WHO ARE MARGINALIZED MOST IN OUR COMMUNITY ARE WOMEN OR MINORITIES, AND OUR VETERANS HAVE EVERY OPPORTUNITY POSSIBLE IF THEY ARE A CONTRACTOR AND CERTIFIED BY THE STATE TO BE INCLUDED ON THIS CONSTRUCTION PROJECT, AND I ENCOURAGE MY COLLEAGUES TO VOTE IN FAVOR. THANK YOU. MR. CLERK. ON THE QUESTION. ALL IN FAVOR? AYE. ANY OPPOSED? THE MOTION CARRIES AND THE RESOLUTION IS APPROVED AS AMENDED. CONTINUING ON WITH OUR AGENDA. INTRO 15-2 MAJORITY LEADER MEYERS THIS IS FROM LEGISLATOR TODARO CALLING ON THE COMPTROLLER TO EXAMINE HOTEL OCCUPANCY TAX FOR CERTAIN HOTELS. SEE LEGISLATOR VINAL STANDING. LEGISLATOR VINAL. YES, I'D LIKE TO SEND THIS TO COMMITTEE. THE REASON WHY IS BECAUSE I THINK IT CONTAINS A LOT OF FACTUAL AND LEGAL ISSUES THAT CAN TURN ON YOUR MICROPHONE. I'D LIKE TO MOVE TO SEND THIS TO COMMITTEE BECAUSE I THINK IT CONTAINS A LOT OF FACTUAL AND LEGAL ISSUES THAT NEED TO BE EXPLORED AND ADDRESSED, INCLUDING BUT NOT LIMITED TO ONE OF THE THINGS IN THE WHEREFORE CLAUSE IS SAYING THAT THEY'RE CLAIMING THAT CERTAIN INDIVIDUAL OR THREE INDIVIDUAL BUSINESS PROPERTY OWNERS ARE BEHIND IN THEIR TAXES AND STATING THAT THE TAX DEPARTMENT SHOULD DO EVERYTHING THAT THEY POSSIBLY CAN, INCLUDING FORECLOSURE. SO ARE WE AS A BODY SAYING THAT WE'RE CHANGING THE FORECLOSURE, THAT NOW WE'RE MAKING IT IF YOU'RE THREE MONTHS BEHIND, IF IT'S A BUSINESS, WE DON'T LIKE THAT, THEREFORE WE'RE GOING TO FORECLOSE IMMEDIATELY. I THINK THAT'S A HUGE ILLEGALITY. THAT IS SOMETHING THAT WE SHOULDN'T JUST LIGHTLY JUST SAY, OH, LET'S DO THAT. SECOND IS THAT WE'RE ASKING FOR THE BED TAX REMITTED TO HAVE ACTIONS TAKEN THERE ON FORECLOSURE, WHICH MAY OR MAY NOT BE NEEDED TO HAVE A CHANGE IN THAT LAW. WHEN WE WERE HERE BEFORE ABOUT IT, THE COMPTROLLER STATED SPECIFICALLY THE COMPTROLLER'S DEPUTY COMPTROLLER STATED SPECIFICALLY THAT THERE WAS NO MECHANISM IN OUR CURRENT LAW TO COLLECT THOSE TAXES. THERE'S NO WAY TO FORECLOSE ON BED TAXES AND OR TO SUE ON THEM AND SO THEREFORE, THAT THEY'RE IN EFFECT, AS SHE REFERRED TO IT, AS VOLUNTARY IN THE SENSE OF THAT WHEN THERE'S NO REMEDY TO DO IT, AND I'M NOT TRYING TO PUT WORDS IN YOUR MOUTH, BUT I'M TRYING TO SAY THIS HOW I RECALL IT, AND SO I DON'T THINK THAT IS SOMETHING THAT IN A RESOLUTION THAT WAS WITH NO CONSIDERATION AND NO COMMITTEE, WE CAN SAY THAT NOW BED TAX, LATE PAYMENTS ON BED TAX ARE FOR THESE PARTICULAR THREE PEOPLE ARE GOING TO RESULT IN FORECLOSURE. ALSO, I STATE THAT THERE'S FACTUAL THINGS THAT AREN'T STATED EXPRESSLY IN IT. FOR EXAMPLE, THERE'S A REFERENCE TO A FOUR YEAR OLD STUDY THAT WAS DONE BY THE COMPTROLLER STATING CERTAIN HOTELS WERE USED IN CERTAIN WAYS AND SOME OF THOSE MAY BE THE SAME OR NOT THE SAME , BUT I THINK BEFORE WE TARGET THREE INDIVIDUAL TAXPAYERS, WHICH I'M GOING TO GET TO THE APPROPRIATENESS OF THAT, BUT BEFORE WE TARGET THAT, WE SHOULD ACTUALLY KNOW THE FACTS ON THAT, AND FINALLY, I THINK THAT WE SHOULD AT LEAST CONSIDER WHETHER WE WANT TO BE IN THE BUSINESS OF FIGURING OUT THAT WE DON'T LIKE SOMETHING. SO WE'RE GOING TO APPROACH THREE INDIVIDUAL PROPERTY TAX OWNERS, PROPERTY OWNERS, AND SAY, YOU THREE ARE BEHIND IN THE TAXES AND WE AS A BODY OF 11 ARE POINTING OUR FINGER. THERE'S A LOT OF PEOPLE WHO PAY THEIR TAXES LATE. THEY PAY HIGH INTEREST. THEY DON'T GET THEM. THEY DON'T GET A FREE NOT PAYING THEIR TAXES. THEY PAY HUGE INTEREST RATES ON LATE PAYMENTS. SO I THINK THAT BEFORE WE GET INTO THE BUSINESS OF TARGETING INDIVIDUAL TAXPAYERS PUBLICLY IN THIS WAY, LIKE SHAMING THEM ALMOST IN THIS WAY, THAT I THINK THAT WE SHOULD AND SUGGESTING THAT THEY SHOULD HAVE THESE THREE TAXPAYERS SHOULD BE FORECLOSED ON AS OPPOSED TO BE IN THE NORMAL COURSE OF WAITING FOR WHEN THEY'RE BEYOND THREE YEARS. YES, THEY COULD LOSE THEIR PROPERTY TO FORECLOSURE, BUT I THINK BECAUSE OF THAT, IT'S JUST TOO MUCH TO JUST GIVE IT THE LAST MINUTE WITHOUT A CHANCE AT A COMMITTEE DISCUSSION ABOUT IT AND WITHOUT ACTUALLY THE WHEREFORE CLAUSES THAT ARE SUGGESTING THIS, MAYBE THIS OR MAYBE THAT, DO WE ACTUALLY GET THE FACTS ON THAT? SO FOR THAT REASON, I WOULD ASK THE CHAIR TO CONSIDER SENDING THIS TO A COMMITTEE FOR A FULL DISCUSSION AND FOR ANSWERS TO THESE QUESTIONS AND TO SEE THE LEGALITY OF DOING THESE THINGS. OKAY. WELL, YOU MADE TWO REQUESTS. LEGISLATOR YOU MADE A MOTION TO SEND IT TO COMMITTEE, AND NOW YOU'RE ASKING ME TO SEND IT TO COMMITTEE. I'M NOT AGAINST SENDING IT TO COMMITTEE. LEGISLATOR TODARO I HOPE TO HAVE YOUR SUPPORT TO HAVE A COMMITTEE DISCUSSION ON THIS. DO YOU WISH TO BE HEARD ON THE ITEM OR CAN WE SEND. OKAY. YES, YOU HAVE THE FLOOR, SIR. THANK YOU, MADAM CHAIR. THIS IS NOT A DIRECT ATTACK TO INDIVIDUAL BUSINESSES. THERE'S IN THE RESOLUTION IT SAYS LEGAL STEPS TO BE TAKEN. NO SPECIAL REQUESTS FROM THE COMPTROLLER, BUT ONLY TO INVESTIGATE WHY TWO OF THE THREE HOTELS ARE IN ARREARS. WE ARE NOT. THESE ARE PUBLIC DOLLARS THAT ARE BEING PAID FOR THE ASYLUM SEEKERS. [00:25:05] WE ARE NOT RECEIVING ANY TAX WHATSOEVER FROM THOSE FUNDS IS ANOTHER CONCERN I HAVE, AND THEN WHY? WHY ARE WE ALLOWING THIS TO HAPPEN? THIS IS OUR JOB TO MAKE SURE THAT THOSE FUNDS ARE COMING IN. SO I'M ONLY REQUESTING THE COMPTROLLER'S OFFICE TO MOVE FORWARD AND LOOK INTO IT. THAT'S ALL I'M REQUESTING. THANK YOU. IN RESPONSE TO THAT, I DON'T THINK IT'S APPROPRIATE FOR US TO LOOK INTO THREE INDIVIDUAL TAXPAYERS THAT ARE BEHIND ON THEIR TAXES AND HAVE THE COMPTROLLER LOOK INTO THEM. WE LOOK INTO THEM. WHY IS ANYONE WHY IS THIS MAYBE THERE'S A WOMAN DOWN THE STREET FROM ME THAT'S SIX MONTHS BEHIND IN HER TAXES. ARE WE GOING TO INVESTIGATE THAT WOMAN OR ARE WE GOING TO INVESTIGATE HER? ONLY IF SHE'S DOING SOMETHING THAT WE'RE NOT IN FAVOR OF. I JUST THINK THAT WE HAVE A PROCESS FOR DOING FORECLOSURES AND THAT WILL HAPPEN IF THEY'RE BEHIND ON THEIR TAXES. THIS IS THERE'S NO COUNTY MONEY GOING TO THOSE PROPERTY OWNERS. IT'S A CONTRACT BETWEEN THE STATE AND. THESE PROPERTY OWNERS TO DO THAT. THE ONE HOTEL USED TO BE USED ALL THE TIME BY AAA TO DO ARBITRATIONS. I MEAN, IT'S A PRIVATE CONTRACT AND WE'RE GETTING INTO ATTACKING THREE PROPERTY OWNERS FOR LATE PAYMENTS ON THEIR TAXES. I JUST DON'T THINK THAT'S APPROPRIATE, BUT MAYBE I'M WRONG, AND THAT'S WHY I THINK WE SHOULD HAVE A COMMITTEE DISCUSSION ON IT TO SEE IF THAT IS APPROPRIATE AND THAT THERE IS NO ILLEGALITY ON DOING THAT, WHICH I THINK THERE DEFINITELY IS AN UNSEEMLINESS OF GOING AFTER THREE INDIVIDUAL PROPERTY OWNERS. OKAY. JUST FOR A POINT OF CLARITY, ARE THESE MEMBERS RESPONDING TO EACH OTHER'S QUESTIONS OR ARE THEY SPEAKING ON THE ITEM? THEY ARE. OKAY. DID YOU WANT ANOTHER RESPONSE? LEGISLATOR THE SECOND TIME? YES, MADAM CHAIR. IT'S NOT YOUR SECOND TIME. YOU'RE STILL ON YOUR FIRST TIME. YOU'RE JUST RESPONDING. OKAY. IN RESPONSE TO LEGISLATOR VINAL, YOU STATED THAT THE IT'S NOT COUNTY TAX DOLLARS, IT'S STATE TAX DOLLARS. IT'S STILL OUR MONEY. THIS IS OUR MONEY. LET'S NOT FORGET THAT IT'S IMPORTANT THAT WE KNOW THAT THE TAX DOLLARS ARE BEING UTILIZED CORRECTLY, AND THIS HERE NEEDS TO BE BROUGHT OUT TO THE PUBLIC EYE AND LET EVERYONE KNOW THAT IT SHOULDN'T BE HAPPENING, AND I'M JUST REQUESTING AN INVESTIGATION. I'LL LOOK INTO IT A LITTLE BIT DEEPER. THAT'S ALL WE'RE ASKING. THANK YOU. LEGISLATOR TODARO JUST FOR A POINT OF CLARITY, ARE YOU AGAINST THIS ITEM BEING SENT TO COMMITTEE? THERE IS A PROPER MOTION ON THE FLOOR TO SEND IT TO COMMITTEE, BUT OKAY. FIRST OF ALL, IS THERE A SECOND ON SENDING IT TO COMMITTEE? OKAY SO LEGISLATOR JOHNSON SECONDS SENDING IT TO COMMITTEE ON THE MOTION TO SEND IT TO COMMITTEE. CALL VOTE] THE VOTE IS 6 TO 5. OKAY, SO THIS ITEM WILL BE SENT TO COMMITTEE. RESPECTFULLY, LEGISLATORS WILL REACH OUT TO THE OFFICE OF REAL PROPERTY TAX OR YOUR TEAM AND THE COMPTROLLER AND MAKE SURE THAT WE HAVE A COMMITTEE DISCUSSION ON THIS ITEM. OH, WE WILL SEND THIS TO FINANCE AND MANAGEMENT. OKAY. CONTINUING ON WITH OUR AGENDA, COMMUNICATIONS DISCHARGED FROM COMMITTEE. [ COMMUNICATIONS DISCHARGED FROM COMMITTEE:] MR. MEYERS, YOU HAVE THE FLOOR. MOVE TO DISCHARGE COMMUNICATION 7E-24 FROM THE ENERGY ENVIRONMENT COMMITTEE. OKAY. THERE'S BEEN A PROPER MOTION TO DISCHARGE COMMUNICATION 7E-24. IT'S BEEN SECONDED BY MINORITY LEADER MILLS. ALL IN FAVOR? ANY OPPOSED? THE MOTION CARRIES, AND THE ITEM IS NOW BEFORE THE BODY. MAJORITY LEADER. THANK YOU, MADAM CHAIR. MOVE TO AMEND COMMUNICATIONS 7E-24 WITH WHAT'S BEEN SENT OUT. THERE'S BEEN A PROPER MOTION TO AMEND THE ITEM MADE BY THE MAJORITY LEADER. IT'S BEEN SECONDED BY LEGISLATOR JOHNSON ON THE QUESTION OF THE AMENDMENT. ALL IN FAVOR? AYE. ANY OPPOSED? THE MOTION CARRIES AND THE ITEM IS AMENDED. MAJORITY LEADER. THANK YOU, MADAM CHAIR. MOVE TO APPROVE COMMUNICATION 7E-24 AS AMENDED. THERE'S BEEN A PROPER MOTION TO APPROVE AS AMENDED MADE BY THE MAJORITY LEADER. IT'S BEEN SECONDED BY LEGISLATOR MILLS. ROLL CALL VOTE AS A DISCHARGE ON THE APPROVAL. [00:30:09] CALL VOTE] 11 TO 0. THANK YOU, MR. CLERK. THE ITEM IS APPROVED AS AMENDED, CONTINUING ON WITH OUR DISCHARGES FROM COMMITTEE. MAJORITY LEADER, YOU HAVE THE FLOOR. [INAUDIBLE] PROPER MOTION TO DISCHARGE MADE BY LEGISLATOR BY OUR MAJORITY LEADER. IT'S BEEN SECONDED BY LEGISLATOR JOHNSON. ALL IN FAVOR OF THE DISCHARGE? HI. ANY OPPOSED OF DISCHARGE? 11-0. THE MOTION CARRIES, AND THE RESOLUTION IS NOW BEFORE THE BODY. MR. MEYERS. THANK YOU, MADAM CHAIR. MOVE TO AMEND INTRO 12-2 WITH WHAT'S BEEN SENT OUT. OKAY. THERE'S BEEN A PROPER MOTION TO AMEND. YES, THERE'S BEEN A PROPER MOTION TO AMEND THE ITEM MADE BY THE MAJORITY LEADER. IT'S BEEN SECONDED BY LEGISLATOR JOHNSON ON THE QUESTION. ALL IN FAVOR? AYE. ANY OPPOSED? THE MOTION CARRIES AND THE RESOLUTION IS AMENDED. MAJORITY LEADER. MADAM CHAIR, MOVE TO APPROVE INTRO 12-2 AS AMENDED. THERE'S BEEN A PROPER MOTION TO APPROVE THE ITEM AS AMENDED MADE BY THE MAJORITY LEADER. IT'S BEEN SECONDED BY LEGISLATOR JOHNSON ON THE QUESTION. THIS IS A DISCHARGE, SO WE'LL HAVE A ROLL CALL VOTE. MR. CLERK. OKAY. THE ITEM IS APPROVED AS AMENDED. CONTINUING ON WITH OUR AGENDA. MADAM CHAIR. YES. LEGISLATOR TODARO, YOU HAVE THE FLOOR. THANK YOU, MADAM CHAIR. I MOVE TO DISCHARGE COMMUNICATION 11E-35 FROM THE PUBLIC SAFETY COMMITTEE. OKAY. THERE'S BEEN A PROPER MOTION TO DISCHARGE COMMUNICATION. 11E-35. THIS IS FROM THE OFFICE OF THE SHERIFF REGARDING LEASE SPACE AT TEN CENTER DRIVE IN ORCHARD PARK. DO WE HAVE A SECOND? MADAM CHAIR, THERE IS A SECOND. YES, WE HAVE A SECOND ON THE RECORD. MAJORITY LEADER. [INAUDIBLE] I WILL ACCEPT A RECESS. WE HAVEN'T STARTED THE VOTE. WE'RE GOING TO DO IT. YEAH, WE WILL HAVE A FIVE MINUTE RECESS. THANK YOU. OKAY. THANK YOU, EVERYONE. WE ARE RESUMING SESSION NUMBER 15 OF THE ERIE COUNTY LEGISLATURE. MR. CLERK, WOULD YOU PLEASE TAKE THE ROLL? CALL] ALL MEMBERS ARE PRESENT. THANK YOU, MR. CLERK. WHEN WE LEFT OFF, WE WERE ON INTRO 11E-35. THERE WAS A DISCHARGE MADE BY LEGISLATOR TODARO, A SECOND BY LEGISLATOR MALCZEWSKI, AND THIS IS ON THE ITEM FROM THE SHERIFF'S OFFICE REGARDING LEASE SPACE AT TEN CENTER DRIVE IN ORCHARD PARK. A DISCHARGE FROM COMMITTEE IS NON-DEBATABLE. MEMBERS IF YOU WISH TO EXPLAIN YOUR VOTE, YOU ARE WELCOME, BUT I'M GOING TO ASK MR. CLERK TO JUST ENTERTAIN A ROLL CALL VOTE ON THE ITEM I'M [INAUDIBLE] YES. YES. YES. TODARO EXPLAIN MY VOTE. THE SHERIFF'S DEPARTMENT'S JUST DISCHARGE. EXCUSE ME. NO. CAN YOU EXPLAIN YOUR VOTE? I WILL SPEAK IF YOU WANT TO EXPLAIN WHY YOU'RE DISCHARGING IT. I WOULD LIKE TO DISCHARGE IT BECAUSE IT'S THE TIME OF THE ESSENCE. SHERIFF GARCIA HAS EXPLAINED TO US TIME AND TIME AGAIN EVERY TIME HE'S VISITED, THAT THIS NEEDS TO BE DONE. THE SAFETY OF OUR EMPLOYEES. YOUR COUNTY SHERIFF'S EMPLOYEES IS BAR NONE A PRIORITY, AND WE SHOULD TAKE THAT. IT'S A VERY SERIOUS MATTER. OTHER THINGS, OUR COUNTY RECORDS, OUR COUNTY ASSETS ARE IN A BUNKER THAT HAS A LOT OF ASBESTOS. THE LIST GOES ON. SO I ASK THAT YOU MOVE THIS ALONG AND HOPEFULLY GET IT PASSED. THANK YOU. THANK YOU, SIR. YES. LEGISLATOR BARGNESI. YES. BASKIN. YES. GILMORE. YES. JOHNSON, YES. KOOSHOIAN MEYERS. YES, AND LEGISLATOR VINAL. I'D LIKE TO EXPLAIN MY VOTE AND WHY I VOTED NO TO THE DISCHARGE, AND THE REASON IS, IS THAT THERE'S STILL SO MANY UNANSWERED QUESTIONS. WE THE LAST TIME WHEN IT WAS BROUGHT UP AS AN AMENDMENT AND IT TURNED OUT TO BE A DIFFERENT PROPERTY, I SAID IT'S A DIFFERENT OWNER. [00:35:01] THEY SAID IT'S THE SAME OWNER. NOW, TODAY THEY SAY IT'S A COMPLETELY DIFFERENT OWNER THEN THE COUNTY, THE EXECUTIVE BRANCH, THE THE THE COUNCIL SAID THAT IT'S THE SAME OWNER, AND THE SHERIFF SAID, I DON'T KNOW WHO THE OWNER IS AND YET THEY'VE TOLD US PREVIOUSLY THAT THE SHERIFF WAS OUT THERE MULTIPLE TIMES WITH THE OWNER. SO EVEN THAT WE DON'T KNOW WHO THE OWNER IS, AND THEN HOW ARE WE GOING TO SAY THAT IT'S A RESPONSIBLE OWNER WHEN ALL WE KNOW FOR SURE IS THAT THEY PROVIDED A LEASE LAST YEAR AT A PROPOSAL WHICH SAYS THEY MUST KEEP IT OPEN FOR SO MANY A TIME, FOR SO LONG, AND THEN THEY SAID, WE CAN'T SELL IT TO YOU EITHER BECAUSE THERE'S A NEW TENANT, EITHER BECAUSE THE TENANT EXTENDED OR WHATEVER THE REASON THEY COULDN'T DELIVER, AND THAT TO ME IS AT LEAST THE SUGGESTION THAT THEY'RE NOT A RESPONSIBLE BIDDER. IF THEY ALREADY TRIED TO OFFER A PROPOSAL AND THEN DIDN'T, AND THEN THEIR ANSWER IS LET'S GET A NEW PROPERTY ACROSS THE STREET, LET'S DOUBLE THE PRICE AND LET'S INCREASE THE ESCALATOR BY A THIRD, AND I THINK THAT IS SOMETHING THAT WE SHOULD BE TALKING ABOUT, AND NOT JUST BECAUSE IT'S THE SHERIFF ASKING OR JUST BECAUSE A PARTICULAR FAMILY IS ASKING. THAT'S NOT SOMETHING THAT WE SHOULD JUST GLOSS OVER. LET'S GIVE THEM OFF OF THEIR CONTRACT WITHOUT WHY DON'T WE SUE THEM FOR THE FIRST CONTRACT THAT THEY SAID THAT THEY WOULD PROVIDE AND THEN THEY DIDN'T PROVIDE AND THEY'RE DOUBLING THE PRICE AND INCREASING BY A THIRD. I THINK THAT'S AT LEAST WORTH A DISCUSSION. THE OTHER THING IS, IS IT BECAUSE IT'S A TEN YEAR LEASE, IT HAS TO HAVE A PUBLIC HEARING. SO EVEN THOUGH WE CAN DO ONE BEFORE THE OTHER, THERE'S STILL NO IMPETUS TO DO IT IMMEDIATELY BECAUSE OF THE FACT THAT WE'RE STILL GOING TO HAVE THAT EVENTUALLY. SO THERE SHOULDN'T BE AGREEING TO SPEND ALL THIS MONEY. THE OTHER THING IS, IS THAT THE DOCUMENT IN FRONT OF US NEEDS TO GET AMENDED ANYWAY BECAUSE IT DOESN'T INCLUDE THAT 750,000. ANOTHER THING IS, IS THAT THEY'RE STILL GOING TO BE USING WE'VE HEARD HERE THAT THIS IS CONDEMNED. WE'VE HEARD IT'S BEING DECOMMISSIONED, BUT NOW WE FIND OUT THAT, IN FACT, THEY'RE GOING TO BE USING IT FOR STORAGE FOR THE COUNTY, NOT FOR THE SHERIFF. SO IT'S NOT GOING TO BE TORN DOWN OR FULLY DECOMMISSIONED OR MAYBE IT IS, BUT RIGHT NOW, WE DON'T EVEN KNOW THE ANSWER TO THAT QUESTION. SO I WOULD ASK THAT THEY AT LEAST WE GO TO COMMITTEE, BUT IF YOU WANT TO DISCHARGE IT NOW , BUT THESE ARE ALL THINGS THAT I JUST WANT TO PUT ON THE RECORD THAT WE AS A BODY DON'T KNOW. WE HAVE MISINFORMATION AND WE CAN'T JUST THERE SHOULDN'T BE ANY ELECTED OFFICIAL THAT WE FEEL SO MUCH THAT WE MUST KOWTOW TO THEM IF THEY ASK FOR SOMETHING, THERE SHOULD BE NO FAMILY, THAT WE MUST JUST ACCEPT ANYTHING, DOUBLE THE PRICE ON US, INCREASE THE ESCALATOR. WE SHOULD BE ABLE TO TALK ABOUT IT AS A GROUP AND DECIDE THIS AND NOT BE BULLIED INTO DOING IT WITHOUT IT, EVEN WHEN THERE'S NO BASIS TO DO IT. SO FOR THOSE REASONS, I'M VOTING NO ON THE DISCHARGE AND OBVIOUSLY NO ON THE OTHER PART TOO. [INAUDIBLE]. LEGISLATOR TODARO. THIS IS WHERE I MAKE A MOTION TO APPROVE APPROVE THE AMENDMENT. I'M SORRY. AMENDMENT. THERE'S BEEN A PROPER MOTION TO AMEND BY LEGISLATOR TODARO AND SECONDED BY LEGISLATOR MALCZEWSKI ON THE QUESTION. ALL IN FAVOR? I'M SORRY, I HAVE A QUESTION ON THE AMENDMENT. OKAY. ON THE QUESTION OF THE AMENDMENT. NO QUESTIONS. CAN SHE ASK A QUESTION TO THE SPONSOR ON THE AMENDMENT? THIS IS A COMMUNICATION, RIGHT? THE COMMUNICATION. YOU CAN POSE YOUR QUESTION. LEGISLATOR I DON'T KNOW WHO YOU'RE ASKING THE QUESTION TO, THOUGH. MY QUESTION TO THE SPONSOR OF THE AMENDMENT IS WHERE'S THE 750,000 THAT THE THE THE WE FOUND OUT TODAY THAT THE PROPERTY OWNER IS GOING TO PUT IN. WHERE IS THAT IN THE AMENDMENT? ARE WE APPROVING IT WITH THE 750 OR WITHOUT THE 750? IS MY QUESTION, BECAUSE IT'S NOT MENTIONED IN HERE AND IT WAS MENTIONED TODAY. ARE WE GETTING UP TO 750 AND LETTING HIM HAVE THE PASS, APPROVING THE ITEM AS IT'S BEFORE THE BODY? SO WITHOUT THE 750, WE'RE LETTING IT HAVE A PASS AND WE'RE GIVING OUT 750,000 TODAY FOR THIS RESTAURANT. YOU PROPOSED THE AMENDMENT. DID YOU KNOW IT'S COMING FROM THE OFFICES, THE OFFICE OF THE SHERIFF AND DPW? THEY IT'S A COMMUNICATION. SO IT'S A COMMUNICATION AMENDMENT. SO SOMEONE HAS I KNOW THEY'RE AMENDING THE COMMUNICATION. THE DEPARTMENTS ARE AMENDING THE COMMUNICATION. SO I THINK THAT MAY HAVE BEEN BETTER SERVED DURING THE WORK SESSION WHEN THEY WERE PRESENT. IT WAS WE ASKED AND HE SAID THAT THEY CAME UP WITH ANOTHER 750 SINCE THIS WAS WRITTEN, BUT WE'RE GOING TO APPROVE SOMETHING TODAY THAT DOESN'T HAVE THAT 750 IN THERE. ARE WE GIVING IT UP THEN AND GIVING THEM A PASS ON THAT TOO, OR ARE WE NOT DOING THAT? I'M JUST ASKING THE QUESTION OF OUR FELLOW MEMBERS IS THAT ARE WE AMENDING IT WITH THE 750 OR WITHOUT THE 750? THAT'S ALMOST $1 MILLION TO THE COUNTY THAT WE'RE JUST GIVING THEM WITH APPROVING THIS TODAY BECAUSE IT HAS TO BE SO URGENT. UM, I'M GOING TO CALL IT FIVE MINUTE RECESS. [00:40:06] ZOOMING SESSION NUMBER 15 OF THE ERIE COUNTY LEGISLATURE JULY 20TH, 2023. MR. CLERK, WOULD YOU PLEASE TAKE THE ROLL?. CALL] ALL MEMBERS PRESENT. OKAY, SO WE WERE ON THE MOTION TO AMEND, AND LEGISLATOR VINAL WAS ACKNOWLEDGED TO ASK A QUESTION. SHE POSED HER QUESTION. WE RECESSED AND I'M GOING TO ACKNOWLEDGE LEGISLATOR TODARO ON THE FLOOR. THANK YOU, MADAM CHAIR. I MOVE TO RESCIND MY PREVIOUS MOTION TO AMEND. OKAY, SO THERE'S BEEN A PROPER MOTION. OKAY, SO HE'S JUST SENDING HIS PROPER. PROPERLY RESCINDING HIS PREVIOUS AMENDMENT. LEGISLATOR TODARO. MADAM CHAIR, I MOVED TO AMEND WITH WHAT'S BEEN PASSED OUT TO WHAT'S BEEN PASSED OUT. THANK YOU. SO THERE'S BEEN A PROPER MOTION TO AMEND THE ITEM WITH WHAT'S BEEN PASSED OUT. MADE BY LEGISLATOR TODARO. IT'S BEEN SECONDED BY LEGISLATOR MALCZEWSKI ON THE QUESTION. ALL IN FAVOR? AYE. ANY OPPOSED? WE'RE AMENDING THE ITEM WITH WHAT'S BEFORE YOU. YOU'RE IN THE NEGATIVE. OKAY. OKAY. SO THE MOTION TO AMEND IS APPROVED. LEGISLATOR TODARO. MOTION TO APPROVE AS AMENDED. MOTION TO APPROVE AS AMENDED. PROPER MOTION TO APPROVE THE ITEM AS AMENDED MADE BY LEGISLATOR TODARO. IT'S BEEN SECONDED BY LEGISLATOR MALCZEWSKI. ON THE QUESTION. ON THE QUESTION. ON THE QUESTION. SO READING THE AMENDMENT AND THIS ENTIRE PARAGRAPH THAT SAYS DELETE ALL RESOLVED CLAUSES AND REPLACE WITH THE FOLLOWING. SO WE'RE STARTING ON A NEW THING. SO BASICALLY THIS IS SAYING THAT WE'RE ASKING THAT ON THE ONE HAND IT'S RESOLVED AS IF THERE'S A LEASE THAT IS NEGOTIATED AND THAT'S GOING TO BE $710 A YEAR FOR FOUR YEARS, AND THEN ON THE OTHER HAND, WE'RE ASKING NOW TO HAVE PLANNING TO DO THE BUILD OUT TODAY OF 786,000. WE'RE ADDING THE RESOLVE CLAUSE THAT SAYS THAT IT'S CONTINGENT ON A CONTRACTUAL 750 ALLOTMENT FROM THE LANDLORD FOR BUILD OUTS. SO WE'RE SAYING THAT IF THE LANDLORD DOES AGREE TO THE 750, THEN WE WILL USE THIS MONEY AND IF THEY DON'T AGREE, WE WON'T USE. BUT THE THING IS THAT THE LEASE HASN'T. THE WHOLE THING IS, IS THAT THIS IS A RUSH JOB THAT IS MAKING IT THAT IT'S GOING TO PUT WE'RE GOING TO LOSE. WE'RE SPENDING 786,000 ON SOMETHING THAT WE DON'T HAVE A CONTRACT WITH SOMEBODY THAT ALREADY WE DID THIS THE LAST TIME THEY TOOK IT BACK AND DOUBLED THE PRICE, AND WE'RE TRYING TO I JUST THINK THAT WE'RE RUSHING THIS FOR NO REASON. WE DON'T HAVE THE LEASE NOW AGREED TO. WE STILL HAVE TO HAVE THE PUBLIC HEARING, AND THERE'S STILL QUESTIONS LIKE SOMETIMES IF YOU ACT IN HASTE, YOU REGRET IT EASIER, AND I THINK THIS IS ONE OF THOSE TIMES. SO I WOULD ASK THAT THIS BE VOTED NO NOW NOT TO PUT THE WHOLE THING OUT, BUT JUST THAT THIS PUTTING THE 780 TOWARDS IT NOW THAT IT BE WAITED UNTIL THE WHOLE THING IS DECIDED AND APPROVED ON THE QUESTION, THE MOTION IS TO APPROVE AS AMENDED. OKAY. ROLL CALL VOTE, MR. CLERK. LEGISLATOR GREEN. YES, I'LL EXPLAIN MY VOTE. YES. NO IS NOT. IS THERE A MOTION TO APPROVE AS AMENDED? AS AMENDED? AT THE START OF THE DAY, I DIDN'T KNOW WHERE I WAS GOING TO BE ON THIS PARTICULAR ISSUE. THERE WERE CERTAIN THINGS THAT DIDN'T SIT WELL WITH ME AND I NEEDED MORE INFORMATION, AND THANKFULLY, THE SHERIFF SHOWED UP HERE AND WAS ABLE TO CLARIFY A COUPLE OF THOSE THINGS. IF YOU LOOK AT ALL OF THE PROPERTIES, OBVIOUSLY WE KNOW THAT 103 NEW YORK STATE LAW ISN'T THE GREATEST WRITTEN LAW AND WOULD EVEN ALLOW THIS NOT TO HAVE TO GO TO BID. BUT WITH THAT SAID, WHEN YOU LOOK AT THE STRATEGIC LOCATION OF ALL THE PROPERTIES THAT WERE BID, THERE'S ONLY TWO THAT MAKE SENSE AS FAR AS ACCESS TO THE THRUWAY , AND THE REASON THAT'S IMPORTANT IS WHAT HAPPENED TO ME ON MONDAY NIGHT. ON MONDAY NIGHT AT 12:15 A LITTLE PAST MIDNIGHT, MY SON WOKE ME UP. MY DRYER WAS ON FIRE, SMOKE WAS COMING OUT, AND IT WAS PRETTY, PRETTY BAD, AND THE ONLY THING THAT STOOD BETWEEN MY HOUSE GOING UP AND JUST HAVING SMOKE DAMAGE WAS THE FIRE COMPANY GETTING THERE IN A TIMELY MANNER, KNOWING THAT THERE IS GOING TO BE EMERGENCY SERVICES THAT NEED TO [00:45:01] BE NEED TO BE REPLYING TO A VARIETY OF DIFFERENT ISSUES OUT OF THESE LOCATIONS. IT'S VERY, VERY CLEAR THAT WE NEED ACCESS TO A THRUWAY AND THE CENTER DRIVE LOCATION SEEMS TO BE TAILOR MADE TO WHEN SECONDS COUNT AND MINUTES COUNT. THIS IS THE LOCATION THAT MAKES THE MOST AMOUNT OF SENSE AND I STAND IN FAVOR. THANK YOU. THANK YOU, SIR. CALL CONT'D] WE'VE JUST SCRATCHED THE SURFACE WITH THIS ISSUE. I DON'T THINK ANYBODY HAS EVER QUESTIONED THE ACTUALLY THE LOCATION OR WHAT IS THE BEST INTEREST IN LOCATION FOR A TIMELY FASHION. THAT'S THE SHERIFF'S DECISION. WE RESPECT THAT, BUT OUR DECISION HERE TODAY IS TO MAKE THE BEST FINANCIAL DECISION FOR THIS COUNTY, AND WE RAISED SOME QUESTIONS THAT WERE KIND OF ANSWERED. THE QUESTION WE RAISED CREATED MORE QUESTIONS, AND AS YOU SEE, WE HAD A COUPLE TIMEOUTS, WHATEVER YOU WANT TO CALL THEM, DELAYS FOR MORE DISCUSSION, IT WAS MORE DISCUSSION ON PROCEDURE. IT WASN'T DISCUSSION ON WHETHER TO DO IT OR NOT, AND THERE STILL SEEMS TO BE A LOT OF QUESTIONS ON PROCEDURE. NOW, WHAT DO I MEAN BY THAT? WE'RE APPROVING HERE TODAY, IN ESSENCE, THIS TO MOVE FORWARD. IT'S NOT AN EASY IT'S NOT A TEN YEAR LEASE, WHICH THE APPLICANT ATTORNEYS ARE SITTING RIGHT OVER HERE, SAID THEY HAVE TO HAVE A TEN YEAR LEASE OR IT DOESN'T WORK FINANCIALLY. BECAUSE THERE HAS TO BE A LOCAL LAW. WITHOUT THE LOCAL LAW, WE CAN'T SIGN A TEN YEAR LEASE. SO THE QUESTIONS THAT WERE BROUGHT UP WERE VALID. THIS WAS RUSHED, BUT I'M GOING TO VOTE YES TO APPROVE THIS TODAY BECAUSE IT SEEMS LIKE THERE'S MORE QUESTIONS THAN ANSWERS, AND WHAT WAS EXPLAINED TO ME LITERALLY FIVE MINUTES AGO WAS WE NEED TO MOVE THIS FORWARD TO ANSWER THE QUESTIONS. IT'S NOT A LEASE. THE SHERIFF'S NOT GETTING A LEASE. YOU'RE NOT MOVING IN. I DON'T KNOW IF YOU UNDERSTAND IT OR NOT, BUT IT DOES ALLOW THE PROCESS TO MOVE FORWARD, WHICH WE WERE ALL IN FAVOR OF. IT'S BACKWARDS. WE DID THIS BACKWARDS BECAUSE IT WAS RUSHED. THE THE LOCAL LAW SHOULD HAVE BEEN FIRST SO WE COULD HAVE PROPERLY APPROVED THE LEASE FOR THE APPLICANT TO MOVE FORWARD. THEY'RE NOT MOVING FORWARD WITHOUT A TEN YEAR LEASE. DOESN'T MAKE FINANCIAL SENSE [INAUDIBLE] ANYTHING TO APPROVE IT, BUT I THINK WE HAVE TO MOVE IT FORWARD TODAY. THIS INITIAL AMOUNT OF MONEY SO WE CAN THEN GET TO WHERE WE NEED TO GO. WE'LL ALL BE BACK HERE FOR A LOCAL LAW. TO SEE THINGS THROUGH THE RIGHT WAY. THANK YOU. THANK YOU. THANK YOU, SIR. CHAIR BASKIN. EXPLAIN MY VOTE. I THINK MY COLLEAGUE, LEGISLATOR BARGNESI SAID IT VERY WELL. THIS PROCESS WAS JUST KIND OF TURNED INSIDE OUT AND DONE BACKWARDS. HOWEVER, I DO UNDERSTAND A MAJORITY OF WHAT HAS BEEN LAID OUT BEFORE THIS BODY AND BEING SOMEONE THAT HAS ALWAYS PRIORITIZED COUNTY FACILITIES, BEING KEPT TO A POSITION WHERE THEY ARE SAFE AND WHERE THE PUBLIC, ESPECIALLY AROUND PUBLIC SAFETY, HAS IMMEDIATE ACCESS TO COUNTY SERVICES AND THAT EMPLOYEES OF THE COUNTY HAVE COMFORT AND THAT THEIR SAFETY IS PRIORITIZED. LEGISLATOR VINAL IS MY FRIEND, BUT I COMPLETELY DISAGREE WITH COMMENTS THAT WOULD REFLECT ANYBODY IN THIS BODY, ESPECIALLY ME BEING PUSHED AROUND BY THE SHERIFF, BEING BULLIED BY THE SHERIFF. I HAVE A HISTORY OF BEING IN THIS BODY AND STANDING UP TO THE SHERIFF'S OFFICE, AND THERE WAS A TIME BEFORE THIS CLASS OF LEGISLATORS WERE HERE WHERE I WAS THE ONLY PERSON THAT WAS STANDING UP TO THE SHERIFF'S OFFICE QUITE AGGRESSIVELY. SO I DON'T GET PUSHED AROUND BY MY COLLEAGUES IN GOVERNMENT AT ALL, AND I THINK THAT MY VOTE OF YES TODAY IS A REFLECTION OF ME WANTING TO SEE THE SITUATION WITH THE BUNKER, FIND RESOLVE, MOVE FORWARD, AND KNOWING THAT THE POWER THAT I HAVE AS A LEGISLATOR AND YOUR PARTNER HERE IN GOVERNMENT TO REVIEW DOCUMENTS, TO RESCIND VOTES AND TO CHANGE UP HOW [00:50:01] THINGS GO CAN BE EXERCISED AT ANY MOMENT. SHOULD I FEEL THE TAXPAYER DOLLAR IS BEING ABUSED? AND I HAVE ALWAYS OPERATED THAT WAY. I INTEND TO OPERATE THAT WAY. I'M KEEPING MY EYE ON THIS SITUATION, BUT I DO UNDERSTAND THE URGENCY AND THE NEED FOR SAFETY REASONS TO MOVE FORWARD. SO MY VOTE IS YES. THANK YOU, MA'AM. OKAY. THE ITEM IS APPROVED AS AMENDED, CONTINUING ON WITH OUR AGENDA. [ SUSPENSION OF THE RULES:] SUSPENSION OF THE RULES. MAJORITY LEADER, YOU HAVE THE FLOOR. THANK YOU, MADAM CHAIR. SO I'M GOING TO VOTE NO ON THIS. THANK YOU. VERY SIMPLE. THERE'S A PROCESS IN PLACE FOR A REASON.
