AND THERE'S A GRANT PROCESS RIGHT NOW THROUGH ENVIRONMENTAL PLANNING, WHERE DEVELOPERS WHO ARE SEEKING TO DEVELOP MORE AFFORDABLE HOUSING ACROSS ERIE COUNTY CAN APPLY FOR THAT FUNDING. WE DON'T WANT IT TO STOP BECAUSE 2024 IS THE CUTOFF FOR, ARP FUNDING TO BE SPENT. SO WHAT LEGISLATOR JOHNSON AND I ARE LOOKING TO DO IS TO AMEND THE CHARTER AND ALLOW FOR COUNTY GOVERNMENT TO BE ABLE TO CONTINUE TO SUPPORT AND FUND AND, BASICALLY MAKE SURE THAT AFFORDABLE HOUSING IS A FUNCTION THAT COUNTY GOVERNMENT CAN FUND. MY UNDERSTANDING IS WE FUNDED IT IN THE BALANCED BUDGET AMENDMENT LAST YEAR. I GUESS THAT WAS MAYBE TWO DIFFERENT POTS. SO THAT'S WHAT I'M SAYING IS I THINK WE ALREADY HAVE THIS POWER. I DON'T KNOW IF ANYBODY'S LIKE, I DON'T KNOW IF WE'VE TOUCHED BASE WITH THE COUNTY, THE COUNTY ATTORNEY, BUT IT SEEMS LIKE WE HAVE THIS POWER RIGHT NOW TO ALLOCATE MONEY IN THIS MANNER. NO, RIGHT NOW WE'VE BEEN ABLE TO DO IT BECAUSE WE HAVE. THOSE WEREN'T ARP FUNDS LAST YEAR. IT WAS, THE, IT WAS IT WAS IN THE STATE OF THE COUNTY AND THEN THE BALANCED BUDGETING. SO IT WAS OUR OWN BUDGET THAT WE ALLOCATED THOSE FUNDS. I'M PRETTY CONFIDENT THOSE WEREN'T ILLEGAL. I'M PRETTY SURE THAT RENEW PLAN FUNDING WAS A COMBINATION OF MONEY, SOME FROM ARP AND SOME FUNDING FROM, THE SURPLUS THAT WAS ROLLED OUT AS AN INITIATIVE. SEVERAL DIFFERENT INITIATIVES AND ALL FUNDING THAT WE DID FOR AFFORDABLE HOUSING WAS PULLED FROM ARP FUNDING. AND SO WHAT WE'RE LOOKING TO DO, TO THE BEST OF MY KNOWLEDGE, IS, AM I CORRECT, JORDAN. YEAH, CORRECT. SO ESSENTIALLY ALL THE FUNDING PREVIOUS TO THIS WAS SOME FORM OF ARP AND FEDERAL FUNDING. AS OF RIGHT NOW, IT'S NOT THAT, FROM MY UNDERSTANDING, TALKING TO THE COUNTY ATTORNEY'S OFFICE, IT'S NOT THAT WE CAN'T FUND AFFORDABLE HOUSING. IT'S JUST IT'S NOT CLEAR IN OUR CHARTER OR ANY OF THE STATE GUIDELINES. SO WHAT THEY'RE INTENDING TO DO IS IN THE FINDINGS SECTION, LIKE IN THE MIDDLE, IT SAYS THERE'S NOW HOUSING CRISIS IN ERIE COUNTY. SO WHAT THE COUNTY ATTORNEY'S OFFICE RECOMMENDED WAS JUST LOOKING NOT LIKE CREATING SOMETHING OUT OF THIN AIR, BUT LOOKING AT THE STATS AND WHERE WE ARE, YOU KNOW, WE CAN FIND IT AND ESTABLISH THAT AS A HOUSING CRISIS AND MAKE THIS LOCAL LAW AND PASS IT ADOPTED THIS BODY, ADOPTS IT. AND THEN WE CAN, IF WE WANT TO MOVE FORWARD AND FUND IT, BECAUSE THIS OTHER BODY HAS IDENTIFIED IT AS AN ISSUE IN ERIE COUNTY. SO WITH COUNTY FUNDS. SO THE MONEY WAS NOT PART OF THE BALANCED BUDGETING LAST YEAR. I'M NOT SURE EXACTLY WHAT I DON'T UNDERSTAND YOUR QUESTION. MONEY BEING A PART OF THE BALANCED BUDGET. WELL, WITH LAST YEAR, MY UNDERSTANDING IS I THINK WE HAD A 28TH AND THEN A $5 MILLION COMBINED. I BELIEVE THAT WAS ARP FUNDING. YES. SO THAT WAS NO BALANCED BUDGET. I BELIEVE IT WAS CARRIED FORWARD. SO WITH THIS LOCAL LAW WILL POTENTIALLY DO IS ALLOW THIS HONORABLE BODY TO BE ABLE TO SUPPORT COUNTY FUNDING AS WE SUPPORT AND SEE NEEDED TO BE ABLE TO ADDRESS THE HOUSING CRISIS THAT ALL OF OUR DISTRICTS ARE FACING. THERE IS NO LANGUAGE IN THE CHARTER THAT SAYS THAT COUNTY GOVERNMENT CAN GIVE FUNDING TO ADDRESS AFFORDABLE HOUSING. AND ALL THIS LOCAL LAW IS DOING IS SAYING ERIE COUNTY, SHOULD IT DECIDE TO DO THAT, SHOULD WE DEVELOP ANOTHER PROGRAM SIMILAR TO WHAT WE HAVE? SHOULD ROCK COME TO US JUST SPECIFICALLY FOR FUNDING, SPECIFICALLY FOR AFFORDABLE HOUSING AND NOT POVERTY INITIATIVES THAT WE ARE ABLE TO BE ABLE TO GIVE FUNDING SPECIFICALLY TO AFFORDABLE HOUSING. RIGHT NOW, THE COUNTY ATTORNEY'S OFFICE SAYS THAT IS AN AMBIGUITY. THERE'S TOO MUCH AMBIGUITY AROUND IT. AND SO WE JUST WANT CLEAR LANGUAGE THAT ALLOWS US TO ADDRESS THE ISSUE. SO ANY FUNDING THAT MR. CERNEY AND HIS TEAM CURRENTLY GETS, DOES AND THERE IS NO PROGRAM, WE WOULD HAVE A CANVAS TO CONTINUE, ONE THAT CURRENTLY EXISTS. IF WE FIND THE FUNDING AND THE BUDGET OR CREATE OUR OWN AND ADDRESS THE HOUSING CRISES THAT WE HAVE. SO, THERE WAS A PUBLIC HEARING ON THIS HAS BEEN CLOCKED IN FOR A LONG TIME. I THINK THAT ALL OF US PROBABLY HAVE AFFORDABLE HOUSING, MATTERS THAT NEED TO BE ADDRESSED IN ALL OF OUR DISTRICTS. HOWEVER, THIS LOCAL LAW IS NOT ABOUT A PLAN. THIS LOCAL LAW IS NOT ABOUT FUNDING. THIS LOCAL LAW IS NOT ABOUT WHAT WE INTEND TO DO TO ADDRESS AFFORDABLE HOUSING, AS IT IS CLEARLY A PASSION OF ALL OF US. THIS LOCAL LAW IS SPECIFICALLY ABOUT THE ABILITY AS A COUNTY TO ADDRESS AFFORDABLE HOUSING, IF WE SO CHOOSE. SO TO THAT POINT, I AM WILLING TO TABLE THIS ITEM OR KEEP THIS ITEM ON THE TABLE SO THAT WE CAN HAVE CLEARER DIALOG ABOUT WHAT THIS LAW IS FOR AND THE FACT THAT THIS LAW JUST KICKS INTO ACTION. WE DON'T, YOU KNOW, OUTSIDE OF WHICH ROADS ARE PRIORITIZED.[INAUDIBLE] TO SAY, HEY, WE SHOULD STOP THIS BECAUSE MAYBE THE COUNTY EXECUTIVE IS THERE TOO MUCH POWER IN PAVING THE ROAD IN AURORA OR SOMETHING LIKE THAT?
